| 302 | Beckley Post-Herald, Beckley, WV, Monday, 20 Jul 1959, p. 1, col. E State Trooper Kills Terrorist Drunken Man Is Felled In Fayette Gun Battle OAK HILL - An elderly man died in a gunfight with troopers Saturday night after hours of terrorizing his neighbors in a drunken fury. Giles Akers was dropped with a single .38 slug in the chest when he came from around a corner and opened fire as his house was approached. People in the little settlement three miles west of here - called White Oak Hollow - said Akers had been drinking and rampaging since early afternoon. He let go 30 to 35 blasts from his .20-gauge shotgun before his death. Two of the men from the hollow went to the State Police detachment at Oak Hill and swore out complaints. The said Akers, 60 years old and the father of eight children, had been making threats to kill his neighbors and shooting at random. Nobody had been hurt, but there was great fear of what might happen next. TWO ANSWER PLEA Troopers C. A. Berkley and R. L. Cutlip were sent out. The heard shooting as the drew near the Akers' small, plain home on a slope in the valley and parked their car to go the rest of the way on foot. Akers wasn't in sight then. He rushed from out behind his house when they were about 60 feed away, shouted profanity, threw his shotgun to his shoulder and began firing. Cutlip heard pellets whiz past his head. He and Berkley drew their service revolvers and began an exchange of shots. Akers dropped with a single wound and died 30 minutes later just as an ambulance arrived. An inquest held Sunday afternoon at Thomas Funeral Home determined it had been a shot by Cutlip that hit. The ruling was justifiable homicide because of self-defense. FACTS OF THE CASE There were the facts of the case as reported by Sgt. C. C. McGraw of the Oak Hill detachment and Justice of the Peace Virgil Lyons, who held the inquest and serves as acting coroner. This further information was given: Akers had not stayed on his property during the hours of terror, but had gone up and down the hollow. He never said what it was that had enraged him - if it had been anything other than just plain drinking. The Akers' home was deserted when the gunfight broke out except for a one-year-old baby. It was thought to the a grandchild. Both of Akers' sons and four of his daughters are married. The wife, Mrs. Elsie Mae Akers, and the girls, Fanny and Phyllis, had gotten away earlier. RURAL PEOPLE The family and their neighbors were described as "rural people," the kind who typically live in small hollows in all parts of the state. The investigation did not bring out what work the father had done. One rumor was that he had retired. About 25 of the people living in the settlement were available as witnesses at the inquest. Only six were called. Questioned afterward, Sgt. McGraw said he didn't think Trooper Cutlip had been shaken up much by the incident. "We realize this can happen to us in our work," McGraw said. "We try to steel ourselves against it. We carry those guns to protect our lives when there's the need." Beckley Post-Herald, Beckley, WV, Tuesday, 21 Jul 1959, p. 2, col. | 307 | Beckley Post-Herald, Beckley, WV, Thursday, 17 Apr 1952, p. 8, col. 4 Run of Mine by Dick Mason Met a man the other day that deserves a lot of credit for making a comeback after a crippling accident. His name is Theodore Neely, who lives near Layland on Backus Mountain. Neely suffered a severely injured spine when he was trapped under a slate fall August 23, 1949. Although not a complete paraplegia, Neely must wear braces and walk with a cane. He received medical care and physical rehabilitation from Kabat-Kaiser Institute specialists at Valejo, Calif., and Washington D.C. He decided that as his new career he would be a poultry farmer. Throught the assistance of the UMWA Welfare Fund and State Office of Vocational Rehabilitation, he got chicks, feed, and the other necessary essentials. For some time he marketed most of his products through his brother's store on Backus Mountain. Due to a needed return trip to the hospital, he was forced to sell his chickens since his wife was unable to take care of them and the small farm he owns, but he is already making plans for returning to the life of a poultry farmer. | Neely, Theodore Seldon Sr. (I50260)

| 319 | Beckley Post-Herald, Beckley, WV, Tuesday, 14 Jan 1964, p. 8, col. D Fayette Man Murdered; Mrs. Morris Is Charged FAYETTEVILLE - A Fayette County woman claiming she was afraid to ride in a car over icy mountain roads with a drinking driver, halted him with three pistol shots through his body, Sunday night. Mrs. Betty Morris, 33, admitted shooting Phillip Ray Akers, 21, with a .38 owlhead pistol after a wild automobile race over Fayette Road about 10 p.m. Akers died instantly. Deputy Sheriff Earl Dempsey, the investigating officers, said Mrs. Morris gave the following account of the events leading up to the fatal shooting: She was originally driving the car. There was another vehicle behind them. Akers, who had been drinking most of the evening, ordered her to pull over and let the other car pass. This done, he told Mrs. Morris to speed up and catch up with the other vehicle so he could shoot at it. Because of the icy condition of the road, she was unable to keep up the race and Akers ordered her to park the vehicle and change places with him. He had been brandishing the pistol, but returned it to the glove compartment before they changed places. It was at this point Mrs. Morris said she became afraid and removed the gun from the compartment and shot Akers "three or four" times. The bullets entered in the vicinity of his ribs and passed through his body. Mrs. Morris hailed a passing motorist and asked him to follow her to the sheriff's office where she admitted the shooting. Dempsey said when he arrived at the murder scene, Aker's body was sprawled face down in the snow. He said Mrs. Morris, the mother of six children, and Akers, had lived in the same house on Crooked Run Road about a mile from Fayetteville, about 18 months. Mrs. Morris was given a preliminary hearing before Magistrate Frank Simms in Fayetteville at 2 p.m. Monday. She waived to the grand jury and was remanded to the Fayette County Jail. No bond has been set. Akers' body is at Dodd-Payne Funeral Home in Fayetteville. Funeral arrangements are incomplete. Beckley Post-Herald, Beckley, WV, Wednesday, 15 Jan 1964, p. 2, col.
