John Eary, Ex-Judge, Succumbs
FAYETTEVILLE - Aug. 4 (RNS) - John Wesley Eary, 80, a former judge, died at his home here at 4:30 p.m. today after a long illness.
He was born Feb. 27, 1875, at Mulvane, Fayette County, and was the son of Alec and Sally Eary. His father was a pioneer settler, farmer, and school teacher. He attended Fayette County schools, West Virginia Wesleyan, West Virginia University, and received his law degree from the University of Virginia. In 1906 he married Miss Ada Arthur.
He was appointed judge of the Fayette County Criminal Court in 1905 upon the death of Judge Koontz. After serving out the unexpired term, Eary was elected for a four-year term. In 1918 he was elected judge of the circuit court of the 12th Judicial District and he served as judge of circuit court until 1936.
Youngest Judge
He was the youngest judge ever to serve in Fayette County and served longer than any other one man. Upon retirement from the bench he practiced law in Fayetteville until he was confined to his home because failing health.
He was a member of the Methodist Church here and served as teacher of the Adult Bible Class and superintendant of the Sunday school for many years.
He was a member and past president of the Fayette County Bar Assn. and LaFayette Lodge No. 67, A.F. and A.M.
Survivors include his widow and two daughters, Miss Gladys Eary, who is a teacher in Fayetteville, and Miss Ruth Eary, a teacher in Kanawha County; one brother, W. H. Eary of Charleston; one sister, Mrs. Leonah Renick of Richmond, Virginia.
Funeral services will be conducted at 3 p.m. Saturday in the Fayetteville Methodist Church with the Rev. C. R. Bright and the Rev. B. B. Breitenbirt officiating. Burial will follow in Huse Memorial Park.
The body will be removed from the Dodd-Payne Funeral Home one hour prior to the services. Masonic rites will be conducted at the grave and members of the Fayette County Bar Association will serve as pallbearers and flower bearers.
